This is an application filed by the Committee to issue a
direction to
M/s Amartex Industries Ltd. to re-deposit the amount that has
been withdrawn by
it as per the undertaking given by the respondent as reflected
from the order
dated 6th September, 2007 passed by the Apex Court in IA
No.84/2007 in IA
No.82/2007 in Transfer Case (Civil) No.2 of 2004
Be it noted that all the matters including the IAs have been
transferred
to this court for adjudication.

It is submitted by Ms.Suruchi Aggarwal, learned counsel for
the
Committee, that the sale has been confirmed by the Supreme
Court on 29th July,
2009 in IA No.27 in T.C.(C) No.68/2003. The said order reads
as follows:
?As regards Item Nos.4 and 10 properties, the purchasers were
permitted to
withdraw their deposited amount of 25%. They are directed to
deposit the entire
bid amount within a period of six months. On deposit of the
same, the Committee
shall see the properties are put in possession of these
parties.?
It is urged by Ms.Suruchi Aggarwal, learned counsel for the
Committee,
that despite service on the respondent, nobody has entered
appearance on behalf
of the company.
In view of the aforesaid, let a bailable warrant of arrest in
the sum of
Rs.50,000/- with one surety in the like amount be issued to
Mr.Arun Grover,
Managing Director, M/s.Amartex Industries Limited, Plot
No.365, Industrial Area
Phase I, Panchkula.
The Managing Director of the company shall remain present in
this Court
on 6th December, 2010. Call on date fixed.

In the course of hearing of this application, a consensus was arrived
at
by the Committee and Mr.Manoj Goel, learned counsel on behalf of the
K.V.Finlease Private Limited, the auction purchaser, that the property
should be
re-auctioned within a period of four weeks.

The auction bid shall be kept in a sealed cover and produced before
this
Court within a period of six weeks. The terms of the re-auction shall
be
determined by the Committee.
